Summons


What is the name of your state? FLORIDA.

I have no income. I am a poor, helpless, starving full-time college student with no assets. I live on rice and beans. My car is worth something. But financially, it is under my mother's name.

Tonight, I was served my first summons for a credit card debt. I owe $10,000 to this company. I owe a total of approximately $100,000 (mostly medical) to all companies. I have not taken action on any debt, nor taken up any new debts in nearly 5 years. I chose not to file for bankruptcy because I believe statute of limitations will run out soon, if not already.

Last payment on this particular debt: 02/07/00

Doesn't Florida have an SOL of 4 years?

How should I answer this summons????????? PLEASE HELP.

btw


The summons reads: "You are commanded to serve this summons and a copy of the Complaint in this lawsuit on the above-named Defendant Dated on: December 9, 2004".

If my last payment was on 02/07/2000 and it is now 02/03/2005.. was I improperly served this summons, given that the SOL in FL is 4 years?
