I received a Summons and Complaint for an old debt. The date of last payment as reflected on my most recent credit report is 12/2001, the account is set to drop of the credit report as early as August 2008, as reflected from one of the credit reporting agencies. Based on the little I know, I believe the statue of limitations has expired for the credit card debt. The Account was purchased by Unifund in 2006 and they outsourced it to an Attorney's Office. On the complaint they have stated that the sum has been outstanding since November 27, 2007. I have not made any payment on the debt with this agency or attorney so that is incorrect, which I wil state in my written answer.

Are they using this as a ploy, thinking the written answer will not be presented and they can automaticlly enter into a judgement or can they really file for a judgement since they purchased the debt. Other than stating this in my answer do I have any other recourse? They also presented a blanket Citibank card agreement without a signature as proof of the debt.

A: I don't know what they are intending. I do know that if you do not answer the complaint, they will get a default judgment against you and then it may be too late.

So, fight this if you do not think you owe the money you promised to pay back.
