| Summons sent through mail and no follow-up... What is the name of your state (only U.S. law)? Minnesota
Just came across this site...Thanks to everyone who puts in time to help out people. Onto my situation-
Last May 08, I received a Summons, Complaint and Acknowledgment through the mail for an old Citi card. It stated I needed to sign and return the enclosed letter or contact them or that they would proceed with further legal action. I called them immediately (I know now I should have done it through the mail) and asked for some verification of the debt as the card was opened 4 years ago and been passed around a lot. They said they would mail me the verification but I never received anything or heard from them on the phone again. It is a law group PA in Minneapolis. In an unrelated incident, I did have a levy put on bank account two years ago for a separate credit card so I do know what can happen but in that case I was delivered a summons in person and stupidly chose to ignore it and my bank account was frozen until I paid it off. Obviously, I don't want that to happen again but I am also worried that this law group never got back to me. I only came across the paper today (Feb 09) as I am preparing my taxes. Should I call them and ask the status or just leave it alone? It is my debt and I wouldn't mind settling with them but they never even verified the debt to me and in addition, nothing for that particular card is even showing up on my credit report. Not the original creditor Citi or any collection agency related to it. Part of me thinks they only have a partial file and wouldn't win in court so they dropped the account when I put up any resemblance of resistance but part of me needs piece of mind. I don't want to open up a can of worms though if I don't have to. It's been since last May since any contact with them. The card was charged off at $2400 and they asked for $5500 in the letter. We never discussed a settlement because we never got past them sending me a verification letter. What should I do? Thanks |
