What is the name of your state? Wisconsin

My husband had a dui in 2004. He passed away early 2005. His fine had not yet been paid in full. He was on a payment plan. Can the state garnish my tax refund for that amount still owed?

You should get a copy of the Death Certificate , and send it to the Office that it was being paid to.

Hopefully they will write it off , as it was HIS fine to pay .

At any rate request a response in writing .

Yes, it was his debt, and now it's his estate's debt. Assuming there is an estate, it is liable to pay. Of course, if he died penniless, then there's nothing to do.

As far as the tax return goes, was it a joint return? If so, it becomes part of the estate mentioned above and subject to collections.
