Unverified medical Bills


What is the name of your state (only U.S. law)? South Carolina

My husband pulled a copy of his credit reports (from each agency) a few days ago. While looking at the reports, we noticed a large number of collection accounts that we knew nothing about. All of these accounts are from a local hospital. The more research that we did, the more we realized that out of the 40 collections accounts that were being reported, there were actually only 8 accounts. The original creditor had reported to numerous collection agencies and each of them had reported as well.

The kicker in this is that we have contacted the hospital (the original creditor) to request documentation to verify the accounts. They can only provide copies of the bills. We requested copies of the "responsible party" paperwork that would have had to be signed upon admission. They were able to provide us with this form on only one account and the signature on the form was from his ex-wife.

The hospital has advised that they don't keep the paperwork on site and that some of the accounts are 3+ years old and they may not still have the paperwork.

My questions are:

Aren't they required the show proof that this is a valid account in order to report this on his credit?

If they are unable to provide the paperwork, aren't they required to remove these items?

IF the debt is invalid, are the collection companies also required to remove the items?

If the patients were his children, then he IS one of the two responsible parties for the bills, and it is perfectly legal for the hospital to pursue him.

This is often sufficient proof that a debt is valid. Nothing in your post suggests your hubby is not responsible for the debts, he will have to do the same if he is sued for the debt.
