Vehicle repo


I'm in the state of Florida and this morning much to my disbelief, I had a knock on my door and the gentleman told me he was here to repossess my car. I'm late by 2 payments and have always paid something. I got put behind by Ivan, but corporate america doesn't care about that. I looked up the Florida repo laws and much to my dismay read that once a payment is late, they can come anytime and get the car. It's not like the north where you have 3 months of not paying before they come and repo the car. I financed the car through Capital One and I have heard nothing but horrible experiences about them. I have the info of where the car is and the gentleman was nice. I called Capital One and I owe 2 payments of $982. Any advice on how to handle this when I call Capital One tomorrow since they are closed on Sundays and also does this automatically go on your credit report? I never received a noticed and in Florida apparently they do not have to send you a notice. Any advice is appreciated. Thank you in advance.

Where did you get THAT idea ?? When they can repo is not governed by state law, its in your loan agreement. Technically they can repo if you're even ONE DAY late.

How to handle it ?? Pay the amount you owe, otherwise they're not likely to listen to you or want to work with you.

You can't tell us that you've NEVER received any late notices or calls from Crap1 to pay up. They do not HAVE to notify you they're going to repo, and you're lucky you got a 'nice' guy and not one that just took off with the vehicle as soon as he found it accessible !

This is one of those problems that has only one solution: money.

If you can come up with the two late payments, that would be a very good start. If you cannot, then negotiate.

Collecting Data


Hey, I'm am also a vicitim of illegal car repossession. I'm collecting data, so please contact me at badrepo aol com if you are/were a victim of harassment, criminal activity, and/ or trespassing in the process of a repossession agent obtaining your vehicle. Please include your best contact info (email preferred) and as much details you can remember to include all businesses and financing companies involved.

I plan to create a comprehensive report and will be more than willing to share details of my findings.
