Vehicle Repossesion


What is the name of your state? NC

I was discharged from bankruptcy in Nov. 04. A vehicle that I own was listed in the bankruptcy and was paid by the trustee. A Repo man showed up at my home the first weekend in March with Repo paper work, he was seemingly nice enough, I explained to him the situation, the car was not here anyway it was in VA. He left and called on the following Mon to tell me he was going to file papers with the court to have the property returned, well that is fine with me because I have the proof I need to show that the car has been paid out. I am not in possesion of the title because the finance company never sent it, even though I had called many times over for it.

While this is being settled what can I do through the courts to insure they will not be able to repo the vehicle?

Did the trustee ever give the car back to you?

Repossesion


The trustee never had the vehicle we have had it the whole time. The finance company now states they never received any payments from the Trustee!

Repo


In addition to all of this the amount that is owed is many times less than what the car is worth.
