Wage Garnishment/Income Ecexution - Help!What is the name of your state? New York, NY I previously posted about this matter and I am looking for more information. I am aware that I am past the point of validation and that I must deal with the Marshal now. My question is that if Cititbank already has a wage garnishment/judgment filed against me and Providian just filed one as well -will I have to pay off the Citibank and Providian simultaneously? CB entered the garnishment/judgement, but to keep them from actually garnishing I have been paying the NY d.o.f. (they are holding the debt) monthly. Does this double garnishment exemption apply when I am paying it directly instead of them garnishing my wages? Please help with info.... Thanks -------------------------------------------------------------------------- I received a "Notice of Garnishment/Income Execution" letter in the mail over the weekend from a NYC Marshall about a cc debt with Providian. I was about to send a letter of validation to the CA that had the debt and they beat me to it by turning over the debt to a marshal to collect. My question is -- Can I still request that the original CA validate this debt or is it too late?? What can I do? I also posted in the recent past about a judgment and wage garnishment that Citibank had against me that I am now paying monthly so they will not go through with the wage garnishment. There is no way that I can afford to pay off these 2 judgments simultaneously along with huge student loans. I am really not sure what to do and what my options are. Please, any advice would be greatly appreciated. Thanks in advance! |

| Only one judgment creditor at a time can garnish your wages unless the 1st one is NOT getting the full 25% allowed by law. If you are already being garnished, then the 2nd one will have to wait. If you're making payments in lieu of garnishment, then its possible that the 2nd CAN garnish your wages.
