What Do I need to do?


What is the name of your state (only U.S. law)? Illinois

I received a summons for the circuit court of cook county...
Paid the Appearance Fee

Was given a court date of 4/30/09.

An Attorney for Capital One is taking me to court for unpaid credit plus court cost for payment loss as of 2/2008.

I was unemployed from 8/2007 through 10/2008.

I'm currently on a payment plan with the my mortgager to avoid foreclosure on my house.

Is there any way I can delay them collecting until 10/2009?

They will most likely obtain a judgement against you. That does not mean they will begin attempting to collect right away. You may have the time you are looking for.

whatever you do, make sure you show up for court and respond to any and all paperwork by the due dates listed.


yes, most likely they'll get he judgment, but then they and you have to go thru post judgement as well. thats where your assests get laid out and have that amount owed attached to it, via wages, bank accounts....lien on house, sale of your personal belongings....whatever you have will be theirs.

it is in your best interest to possibly ask family and friends for a loan for the amount owed and listed on the lawsuit.

the court tacks on addt'l interest.....whatever you owe, will for sure double by the time it gets paid off.
