What To Do Next? Appeal Or No Appeal


What is the name of your state? MICHIGAN

Few things here to cover all bases. I have an debit collector who hired an lawyer and has filed a civil law suit against me.

The lawyer filed the case in the wrong court, asked for a change of venue. It was granted and changed. All parties got paper work for that.

At the pre trial: no judges only an maigsrate took the case becuase the judge is busy and has fallen behind.

1. The plaintiff or the lawyer was late. Was given 15 min to show up. I was told that is the Judges rule of court. He was nearly 35 min late. Hey what happens to rules?

2. The plaintiff did not have all the paper work to prove the complaint is valid at the time of the pre trial. I belived it is out of reach due to statue of limittations has run out.

Now the maigsrate did notthing about this just said everything is in order and will proceed and the case will go on for trial.

Now here is the kicker here

I just got paper work for a motion of judgemnet today. Thanks to U.S. Mail system it was mailed on the 17th of Nov with the postmark and I just got it in my hands today (Dec 5th).

The trial date was set for Dec 14th.

The lawyer has called the court for a date for the motion and picked the date for the motion. Who has the right to pick the dates and time for a trial? The courts or the plantiffs??

Do I have grounds for appeals???
