I am the defendant and the court gave the plaintiff the remaining balance and let it keep the really high rate of 26% So now the amount has gone over the court limits of 10k So does it go to a higher court?

If the judgment is already rendered, it's done. You owe the judgment and if there is added interest, you owe that as well.

If the total sued for itself exceeded the $10k then yes, it should have been moved to a higher court unless the plaintiff was willing to accept the $10k as his judgment.
