What if a credit card company changes their name?


What is the name of your state? pennsylvania

what if the credit card company that I used to have my card with 4-6 years ago, changed their name around 2003 (probably due to all of the states suing them) and now has a different name and they are suing me with the new company name - am a I liable to that new company?

Just a thought here...

Yes. It's not a new company, just the old one with a new name.
Even if the business was sold to another company, all the contracts would be assignable to the new one.

Changing their name doesnt mean they lose their right to seek judgment. If you had changed your name, they would still be able to sue you. So, yes, you are still liable. It's the same company, different name. Your defense against enforcing it would still fall on the sol.

I believe that even if they had be bought out, the new company would be able to sue you. They assume all debts and accounts (even past due accounts where they could seek claims). Would they have all the records needed...that is a different story.

Thank you - - I am going to try to use the SOL defense - and see what they present as far as their DOLA - - I have mine as being on my credit report (which it has been posted the judge might not accept). Then hopefully the judge will be a bit hard on them as far as the countersuit. My fingers are crossed on the SOL. At this point - it's too late for anything else. I'm just sick with worry over this whole thing and their treatment of people, etc... Can't wait for it to be over.

Thank you for the link GulfBreeze - I'm in Montgomery County which is not searchable. I will see what else I can find on google.
