What state for SOLWhat is the name of your state? SC I had a credit card that went to collection in December of 2000. I was in Kentucky when I got the credit card - statute appears to be 15 yrs. for a written contract I have lived in South Carolina, though since 2004 - the SOL in south carolina appears to be only 3 yrs. Which state do I check when determining the SOL? Also, does anyone know if that "3 yr" date applies to credit cards? I looked on the chart and did not know which a credit card fell under. thanks, Last edited by dangerlarson; 03-23-2006 at 06:15 PM. |

| The SOL in SC is 3 years for credit cards and written contracts. The SOL in KY has been argued to be 5 years and people HAVE won on that. IF you are sued, they will most likely sue you where you live now - in SC. In that event, you use the SC SOL as your affirmative defense. While its possible a collection agency or creditor COULD argue the KY SOL, it's not very likely.
