When does SOL actually start? What is the name of your state? Maryland. I was just wondering when does the SOL normally start to tick? Is it when your account for like a Credit Card goes past due or when it goes to collections, etc? |

| Accounding to my State's website (Maryland) the SOL for credit cards is 3 years. I have a few credit cards that went into collections back in 2002 which is now approching the 3 years mark. If I understand the way SOL works when those 3 years are up (like next month) I am not responceable for those Card's bills even if they went to collections? One have been paying on monthly thru a collection agency the others I haven't been paying at all on in fact one has only recently started to try to contact me. If I do not have to worry about those bills it will help greatly in me getting back on my feet. |

Being out of statue is nothing more than an affirmative defense in the event you are sued. They can collect on the debt forever. Q. Making a payment restarts the SOL in most states. Q. If I do not have to worry about those bills it will help greatly in me getting back on my feet. A. Well, I am sure that is true. However, you do still have to worry. Don't ignore any summons you receive. Last edited by Debt Guy; 10-22-2005 at 06:23 PM. |
