Who is responsible for the bill? What is the name of your state? Virginia In July of 2003, my friend's child spent some time with us on vacation. The child developed an ear infection while here and we took her to a outpatient clinic associated with a local hospital. At the time of her admission they called her mother in Oklahoma and got verbal consent to treat her and her insurance information. My husband signed the form for her to be treated. We received one bill from the hospital and then it was turned over to a collection agency. The mother has never received a bill. The mother's insurance did pay a small amount on the bill. The collection agency claims we owe the money because my husband signed for the child to receive care. Do we legally owe the money? The collection agency says so and has threatened to ruin our credit. |

| By signing, yes. However, you should have the mother pay. Why hasn't she paid for it, since it was HER child? |

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport! |

Responsible personColorado Collection agents are a tough bunch. My experience with them has been very negative. You did the right thing caring for the child. Call the provider and find out the total amount due. Immediately, call the mother and get a check from her. A friend will want to pay their debt to you. If not the entire sum, then payments. If unable or unwilling to repay you I do not know the proper recourse - small claims maybe? Collections were honest about one thing - they will ruin your credit- given half a chance. |
