Will court settle for less than debt owed?


What is the name of your state? CA
Being sued for credit card debt - $7k. I had asked to settle beforehand but they would not. Months later, I was served papers to appear in court. What are the chances that I can settle for less than that amount in court? Will they automatically garnish wages if they win? If so, can I file papers in court to prevent wage garnishment? Should I call the debt collector before the court date to attempt one last time to settle and arrange payment schedule? Thanks in advance.

The court is not a mediator. If they prove you owe $7,000.00 then the court will award $7,000.00 (plus costs and etc)

It depends on weather you ignored requests for payment up to this point. If you made no effort to work out an agreement prior to the suit being filed. Then I would not count on the creditor settling for less. why should they cooperate with you at this late stage.

thanks for the reply. i did try to work something out but they would not agree to it. as well, having discovered fraudulent activity on my credit report i requested verification that the account was indeed mine and they did not respond. i have been able to weed out the fraudulent accounts and have been able to settle all the other accounts that are mine, but this one has just been very difficult. thx again.
