Writ of Garnishment


What is the name of your state? Florida

I have a debt that I was paying $100.00 weekly on. When I found out that I could request a letter of validation, I got curious and requested one from the agency/lawfirm that I was paying. I requested this October 2004. I seized payment just for that month because research claimed that I could and also I was curious because when I had requested it in person, the attorney got really snotty and began to sweat profusely questioning as to where did I get the letter. Less than 30 days (November 2004) later they summoned me to court claiming that I had lapses in payment. This court hearing however was just between me and an attorney. I explained why there were delays in payments which I would happily continue paying but that in order to do so I would like my letter of validation. I requested other things as well such as no garnishment, no more additional interest, and that everything from now must be handled by mail/in writing (no more calling my place of employment or home). I as well presented my requests in writing giving a copy to the attorney as well faxing to the law firm. He said no problem and will type it up and have it in the mail in less than 3 days. Well of course I never received. I found out a couple of months later after being completely ignored from these people that I could view my case file at the court for everything that was entered the day of the hearing. Lo and behold, NOTHING was entered. They basically said there was no resolution and that I would not come to an agreement. Which is crap. Fast forward to today and almost a year later. I have requested my letter of validation as well as my initial requests 6 times either by writing, by fax and in person (they refuse to speak to me) and each time I have been harassed with a legal battle. I have issued a complaint with the Attorney General as well as with the State Bar. I have just now received a letter for garnishment however I had 20 days to sign, return, file a hearing, and appeal. I am now on day 21. I plan on doing everything today but I need to know if it is too late. I couldnt do it before since I was out of town for 6 days, due to hurricane everything closed down for two days, car trouble and work. I am doing everything in my power but I feel that I am at a loss. I tried calling the clerks office to find out about legam aid and any programs in my area that can help but If you are anyone who knows the Miami area you should know this is nearly possible since Customer Service is virtually extinct here along with non english speaking personnel who have told me to my face that I am screwed. I really need someone to speak to or should I just shut up let them win and garnish my wages. Oh I also found out there have been previous class action suites against the same law firm in other states dating almost 5-10 years back for the same things (Always threatening legal action to scare people).
