Wrongful Repossession/Replevin


What is the name of your state? WI

Last week, a flat bed truck was showing up to our house, banging on the door, we didnt answer it, had no idea who it was. The 2nd to last time he showed up my hubby was leaving with a friend in the friends car, my hubby asked him who he was, and he said he was with Wisconsin Title Loans. We didnt have any association with them, never had a loan thru them. Back in September of last year, we had recieved court papers in the mail saying we owed money on a loan thru them and they got a replevin to pick up our vehicle. Well, we were quite upset because we never went to their place, didnt even know where it was, and come to find out, someone stole hubbys identity along with scamming the WTL place into getting a loan off our vehicle. We called WTL lawyer who told us that it was a HUGE mistake on their part and others had called as well- the case was dismissed the same day the replevin was activated. We got the paperwork, felt good about it, and filed with the police the identity theft issue.

So here we are, during the holiday week last week, and this repo man shows up AGAIN, on Tuesday, pounding on the door for an HOUR!!! He then proceeds to run around our house, pounding on all of the windows and shouting he is the police. We call 911 to ask if they were dispatched to our home, they say no, and we tell them what this nutcase is doing- no police show up.

The repo man leaves, my hubby and I get into our vehicle, with my now freaked out 4 year old whos shaken by this man pounding on her windows at night, and we go to a friends house.

The police call my hubby back on his cell phone and say he needs to come back to our home immediatedly. He complies, with our friends car and leaves me with our vehicle.

Next thing I know, he calls me on his cell saying that the police man has threatened to arrest my hubby if he doesnt give up our vehicle. He tells him that its not there and that he has to go get it. The cop tells the repo man if it isnt there when he follows my hubby, my hubby will go to jail.

The repo man shows up at my friends house and proceeds to take our vehicle. All he shows my hubby is the replevin which we saw back in SEPTEMBER, yet conviently he DOES NOT have the dissmassal form on it!!
He tells us we have 30 days to contest it and they cant touch it, after that they will sell it.

Alright, I need your help! I have tried to contact lawyers in my area and get NOWHERE! Its a time sensitive issue and Im freaking out because this wasnt even a LOAN we had from someone!!

We did talk to their lawyer again today and she said that our van would be delivered to us on Thursday at our home and that someone didnt see the dismassal form. Should I trust her? What can I do to make sure I get it back, and how do I go about filing suit against WTL?? Do I get a lawyer or can I do Small Claims with this??

The kicker is that you cant even get a loan thru WTL without a clean title, we have a lien on ours from the bank, which we did contact and tell them.
So its near IMPOSSIBLE for us to have ever RECIEVED a loan from them!!

HELP!!
