If you are asking whether or not an employer is required to provide either STD or LTD benefits, the answer is no to both. Disabilty benefits of any kind are optional in 45 states, including yours.

If you are asking whether, in the event that such benefits are voluntarily offered, the employer must provide a copy of the SPD, the answer is yes, they are. Whether it comes from the employer or the insurance carrier, one way or another a copy of the SPD must be provided ON REQUEST. There is not necessarily a requirement to provide it outside of a request, though it is SOP to do so.

However, there is no expectation that the employer be able to reach into a box behind him and hand it to you as soon as you ask. They are allowed a reasonable time to provide one. This can, and often is, between 15 and 30 days, possible to 45 if they are print-on-demand. There are exceptions if there have been major changes to the plan and the plan document is having to be redone; in that case it can be as long as 7 months.
