50/50 Custody


What is the name of your state? Georgia

Our divorce papers state that my ex and I have shared custody of our child. I have him at my home one week and my ex has him at his home the next week. Because of the 50/50 custody, neither one of us pays child support.

My ex is not keeping or visiting with his child on a 50% basis anymore. He only sees him two days out of his week to have custody.

Is this a breech in the divorce agreement? Can I now ask for primary custody and child support? What do I need to do to prove that he is not holding up his end of the agreement anymore?

Yes, that would be a reason to modify custody and child support. However its likely that if you do that, dad will start taking the child for his full week.

any proof that you have keep it. any conversations you have with the father try to record it. anything you can use to prove your case. good luck
