Abandoned With Bills


What is the name of your state?NY

my wife left home about a month ago... no notice, no communication, i have no idea where she is (somewhere in NYC), and am scared to call her job, if she is still working there.

i am primarily concerned at this point as to if i have any legal rights as far as some sort of temporary maintainence or support, seeing as i am unemployed and she has been the sole bread winner for the past 4 years.

mortagage, insurance, etc bills are coming past due and i will be unable to take care of them without assistance.

thx for any and all info and/or advice.

You may be entitled to spousal support. The only to find out is to petition for divorce and support.

is there a minimum time before i can petition the courts for anything?

Technically, no. However the longer you live w/o your wife's income, relying on only your own resources, the less likely your odds of being granted a judgement for SS. You are not doing yourself any favors by waiting to file.

You need to contact an atty. If you have access to marital accounts, which has been asked of you already, then you have the legal right to get into those accounts to help pay bills and fund an atty. If you have no accounts to dip into, call legal aid. If that fails as well, borrow the money from family and/or friends.

What is the reason for your unemployment for the past 4 years?

Since you have been unemployed for the past 4 years, in who's name are these bills?

Get an attorney and file for divorce. From what little information you have provided, your attorney MAY get you awarded maintenance pendite lite by the court until the divorce is resolved.
