abandonment


I am in Virginia and my wife and i got married two months ago and i have not been happy even before we married the only reason why i married her is because she was having my baby my son is one month old. now that we are having more problems after problems she left me and she said she was taking my son and i would never see him again will i have two question since she took my son and she really has no where to go and she left my home and took my baby with my permission can't i file for abandonment and when the case like that. plus do we qualify to get an annulment and i have one more question i changed the locks because i don't want her vandalizing my home so since i am on the lease and she is not can i do that without that hurting me in court.

Do yourself a favor a go get a consult with a local attorney. I doubt that you can qualify for an annulment since a child was born of your marriage.

There is no abandonment. Based on the information you have posted - this is a mutual separation and you gave her permission to take the child with her.

I can't believe you locked your child out! That is basiclly what you have done. She has no where to go, she has your child AND you locked her out! That will look great in court!

you are not reading good


i didn't say she was on the street she went to home moms house i didn't give her permission to take the baby and the baby was conceive before we got married he was born a week later and thats why i married her because he was due

She didn't need your permission to take the baby. Just as you wouldn't have needed her permission to take the baby if you had been the one who left.
