Accident Settlement in Divorce


What is the name of your state (only U.S. law)? Arizona

My husband was in an accident 15 months ago. The case is getting closer to settlement and we are now facing a divorce. His attorney (also a relative of his) stated that my name is listed on the settlement and I will need to sign papers when it is completed. This is quite a huge sum and I do not know if I am entitled to any of it. I don't want much as he is on SS now and will need the money himself. However, I put over 10,000 miles on my car in the 3 months he was in the hospital (it was 125 miles away). My car was an older model to begin with. I cut my work hours back from 10-12 hrs a day to 6 hrs a day to go to the hospital every day. Also, I continued to do all of his wound dressings myself as he refused a nurse, etc. This continued for over 8 months. When I questioned my husband about the papers to be signed, he stated they had nothing to do with me. Then, he called back and told me that his lawyer offered to do a temporary power of attorney so that he could sign for me. I am unsure if I am entitled to any of it and if I am, what percentage? We have been married 5 years and had planned to file the divorce ourselves.

You MAY (big word) be eligible to get part of this settlement.

I agree. You should not sign any paperwork without having an attorney of your own review the paperwork.
