Adultery


What is the name of your state? TX

Define adultery? I was reading a post and was sort of confused about the definition. Could you please explain?

Adultery: Voluntary sexual intercourse between a married person and a partner other than the lawful spouse

You must keep in mind, however that we're talking about legal interpretations. Adultery can be considered if the married person and the partner were together and there was simply enough time for a sex act to occur. Holding hands could be considered adultery! If you're speaking about a specific situation, you should present it and a more precise answer can be offered.

I posted my question and did not have a chance to respond. Thank you. I do know what adultery is. I am aware though that there is a legal interpretation for it. My STB Ex alleges that I am an adulturor because his witnesses, which are basing their knowledge on second and third hand hear say, said they saw me say Hello to a male co-worker of mine at the neighborhood grocery store. Other times they supposedly say they saw me were at a resturant during lunch time with several co-workers both male and female. Is it difficult to prove that someone is committing adultery? Not once have I been by myself with a male for ay extent of time.

~~~Yes...it is hard to prove someone committed adultery. Saying hello, having dinner with male & female co-workers or friends is NOT grounds for adultery. Your husband will have to have solid proof ( possibly pictures) of you in the act. I wouldn't worry about it...especially if you say you never committed adultery.

*A- Oh, really? So I guess that my definition of adultery along with legal interpretation was a prejudiced response?

By the way, If your husband wants a divorce based on adultery, it is one of the possible grounds for divorce in Texas. However, Texas has "no -fault" divorce since it is often difficult to prove a person has committed adultery.

Hope this doesn't sound like I pre-judged.

Sorry, I meant to say did not pre judge my post. I know that in Texas you can file for a no fault divorce. I would definetly prefer to do that; but my STB Ex wants to justify the failure of the marriage by blaming it on me.

~~~Of course he's going to TRY to blame it on you...his ego is at stake lol. What he doesn't want to believe is that's it's over, and it took both of you to end it.
