Advice please?


What is the name of your state? Oklahoma


I have a friend that is going through a horrible divorce and custody battle. He was abused by his wife and he has temporary custody of there 15 month old daughter. My question is that the judge gave temporary custody of the marital home to his soon to be ex wife. She was ordered to pay the utilites and moragate payment. He has been contacte by the morgate company and they stated that if a payment isn't recieved that the house would go into foreclousre. Can he make the payment even though the judge ordered her to and she isn't?

If he is on the mortgage and wants to protect his credit, then yes he should make the payment. He can then go back to court -- or when he goes back to court -- he can tell the judge that his wife has not been following the court order and is in contempt. he definitely needs to save any correspondence from the mortgage company and his checks showing payments he made.
