Question

Alimoney

What is the name of your state?Nevada
Hello, my wife and I have decided to get divorced. We have been separated but in the same house for about 6 months. We have decided to sell the house and it will close at the end of the month. My wife will get $60,000 and I will get $50,000 . As an agreement to getting our divorce my wife wants me to take care of a $10,000 joint credit card we both have, which I agreed to do.
When we get divorced I have agreed that both she and my son will stay on my health insurance (my insurance plan allows for this), she will forfeit all rights to any of my pension.
Does this seem like a fair agreement, the material possessions in the house are not in question, she can have them all. She has not worked in 4 years because she stayed at home to raise my son apart from some small part time jobs which brought in about $120 per week. I have paid all the bills and have continued to pay them since she started a nursing degree 3 months ago. She already has a teaching degree but does not want to teach.
I thought that if I gave her $500 a month child support that this would be adequate since she is making $10,000 more than me on the house even though I have paid the mortgage and all the bills for the past 4 years. We have owned the house for 4 years. She will also be getting health insurance and a $10,000 joint credit card taken care of.
Can anyone see that I should also pay alimoney.

Whether or not this is fair depends on the amount of money in your pension plan...how much of that money was contributed during the marriage...and how long you were married....and whether or not you have to pay for HER insurance (a judge would automatically require you to keep coverage for your son) and how much.

The potential for alimony would depend on the length of your marriage.

Child support is calculated on income. In general, it usually adds up to approximately 17% of your net income (after taxes) or 20% of your gross....plus 1/2 of the child's cost of medical insurance and daycare.

There are online child support calculators available....google to find one for your state and run the numbers.
