am i eligable for an anullmenthi i wanted to know if i was eligible for an anullment. i live in pennsylvania, but was married 2 yrs ago in florida im not sure of florida law. if i am where do i file? i am a recovering addict, and i was under the influence at the time of marriage, and he was also he was on methodone maintenance program. i didnt even remember being married i had to call the clerk of courts in west palm beach to verify it.... please someone help! |

| You might be eligible for an annulment, but a divorce is probably easier and less expensive to do, so I would suggest that you go that route. Go see an attorney in your state. Most offer free initial consultations. |

| i understand a divorce would be easier, but i was in a auto accident and am to recieve a settlement and he's trying to sue me for half. i don't think he deserves none. i was in my accident in august,2001, he was incarcerated in november,2000. he wasnt with me through nothing, the only thing he did was write me a letter stating the only thing i did have was a cute face and thats fu**** up now. when we met i was 16 he was 37, he totally took advantage of my age!!!!!! |

| In order to get an annulment, you have to show more than that you think he's a rotten guy and how you wish to God you hadn't gotten married. You have to show something such as fraud on his part, such that he "tricked" you into marrying, like poisoning your drink and then running to the chapel with you. Or that you were drunk or high when you got married. Or it could be because you were insane at the time and couldn't have had your wits about you. Or it could be because you were under the age where you could legally marry in that state. You might want to talk to your personal injury attorney, but I believe in some states anything that you would receive for pain and suffering in an accident such as yours would be yours exclusively because the pain and suffering was exclusive to you. The $ for damages, such as a wrecked car, hospital bills, etc., would be paid to handle those bills, so he wouldn't have a claim to that, either. If there is a portion of the payment for loss of consortium, however, he might have a claim on that. Talk to the attorney who's handling your personal injury claim for the real scoop on that. OK? Unfortunately, I don't practice law in your state, but I did want to give you some ideas to ponder. As to where you divorce, if you are in the same state as he is, you need to file in that state. If he's in a different state, you can file in your state, and as long as he doesn't contest the jurisdiction of that state, you can proceed there in your state. If he does contest the jurisdiction there, then you would need to refile in his state. Again, an attorney will be helpful here because your case doesn't sound like a cakewalk. Best of luck to you! |
