Am I really divorced?


What is the name of your state? Oregon

I was married in the Connecticut in March 1992 in a secret ceremony. In July of 1992 I had a big wedding for my family in Kentucky,(I married the same man) where I got another marriage license (which at the time I didn't know was illegal). My husband filed for divorce in October 1996 and only put one wedding date on divorce papers. I have ask several people and they are not sure if the divorce is legal because of this. Could someone please shed some light on this for me?

If the petition only put the date of the second marriage it should be amended to show the date of the confidential marriage. In what state was the divorce petition filed?

Which one did he put down on your divorce paperwork?

The biggest problem here is that I am not sure there is much precedent for this. Lots of people get married twice for various reasons...(I did, a quickie to satisfy a legal deadline...my husband's visa was expiring, and a regular church ceremony a week later)....but you are the first person I have ever encountered who got a second marriage license.

I think you are definitely going to have to ask an attorney. My "gut" says that the second marriage was irrelevant since you were already legally married to each other....and that its the first marriage that counts for the divorce....but I am just not certain.

I am also not sure that putting down the wrong date of marriage would automatically invalidate a divorce either.

The divorced was filed in Oregon and he actually put the wrong date altogether. Instead of putting March 1992, he put March 1991 which was off by a year.

I would definitely recommend that you get an attorney to help you get this fixed.

So apparently he was trying to put the first marriage down and simply made a mistake, this can be amended, it is not going to invalidate the entire divorce it that is what you thought. Did you point out this error in your response?
