i am from virginia my husband and i have a separation agreement drawn up by a lawyer and notorized as of 11/99. one issue is the spousal support. it states that he will pay me a certain amt.of money until "i die, he dies, or I remarry". now he's decided to take me to court to try and take away my spousal support because i have been living with a man on and off for about 10 months. my husband says we were living "analagous to a marriage" therefore he is not obligated to pay me any support. the man i have been living with has not supported me financially at all. what are my chances of winning this? my lawyer is fighting this.
another question i have: the man i had been living with will be getting a supoena from my husband's lawyer to bring in all of his tax returns, property deeds, credit card statements, bank statements for all accounts, any receipts for trips he has taken with me, telephone bill statements, and 2 forms of identification including his driver's license. he doesn't want the hassel of all of this so he's avoiding getting the supoena. if he doesn't bring these things in to the lawyer, (these are to be submitted for depositions only), what will happen to him?
