Question

Annulment of divorce


What is the name of your state? WA

My big problem is this.
at the end of last year my wife at the time, left to go back home to washington with our son phoenix, to see her parents for the holidays. I suggested she wait until closer to christmas (she was leaving november 13th) so that I could go as well, so we could all fly togehter, after much fighting, her dad came adn she left with him to washington.

we continued to fight via email, Instant messanger and phone. after much fighting and neither of us agreeing on anything. i got fed up and said, if you dont want to try and settle this, file for divorce then. so mid december she filed for divorce. i was served december 31st (happy new year to me) I didnt have any money, legal aid in ontario cant help me with us courts, so nothing happened. in march i drove cross country to come to my sons 1st birthday. her and I ended up patching thigns up, both talking about how stupid we had been. and since have fixed our problems and our working wel together.

we started seeing eachother and sleeping together march 21st (day after my sons bday) the divorce was finalized april 1st (yes i know haha april fools, only it wasnt a joke) it was finalized then because she feared her parents and didnt want to waste their money on teh divorce.

my problem is, we are moving back in together now, and wed like to annul the divorce so we can file for my work visa, and landed alien status card as a family class application.

I want to know if its possible to annul a divorce, considering that we were already abck together before it was finalized and the circumstances.

any help would be greatly appreciated.

Since there is no residency requirement for divorce in Washington (although she must have actually lived in the state) all she needs to do is withdraw her petition. Tell her to file a motion to dismiss.

Just curious: how do you think the INS will look at this little adventure?

I doubt that it will bother the INS. They have a child so they obviously had a real marriage, and some people do get divorced and then remarry.

thank you all for your replies. your help is greatly appreciated.

also i posted another board before i found this one. and they mentioned checking washington state law about getting the decree vacated. so you know if this would be possible and if so what grounds would be appropriate meens to do so.
