Annulment or Divorce

I got married to my husband in ca on 27sept legally in the court and we got religiously married in the NY on nov 7th and we went to honeymmon to hawaii and i found out that my husband cannot sexullay perform he needs viagara anyways since we came back from honeymoon he had become very violent nad use to force himself on me and would beat me and always say see i am man anyways the violent behaviour , became physical and emotional abuse and when i came back toca to visit my parents in aug and decided not to go back and i wrote him and email saying i shall not returning i want a divorce from him and he said no you file when i tried to file from ca found out that have to be resident for 6 moths so i told him that and he said how does it matter it is a mutual divorce you or i file its the same thing and i agreed now that he has filed he has filed for annulment saying that this was fraud maariage and i got maaried to him for greencard and the funny thing is i did have my interview and did't go through and i was scheduled for 2nd interview in april but i didn't get married to him for greencard so i left him and i want divorce from him i don't annulment from him i had some notes of his apology in which he clearly admits that he will never again physical with me and not when he answere the summon he claims that i made him write all these notes and i got married to him for greencard purpose and that his family has alot of money.

I want to know is annulment easy to get and how much of chance do i have i have his 3 notes in which he apologies for his action at different occasion and i also have mails that i have written to my parents telling them what is happening to me they claim if he was abusing me than y didn't i call the cops or tell anyone , i don't what to do i am so stressed with al these that i having being going to therapist in ca since then i have being going for physical therapy coz all the beating i have one through my back has got messed up .i don't have any pictures or any police reports nor did i tell anyone the only pple i could hang out with was him or his parents they would everywhere with the day my husband worked late my inlwas that live 2 blocks away would keep me at her house till it was time for her son to come home then she would drop me home.He says i am the one who never lets him have sex with him .whic is tollay a lie is that he can't have it .

i am very scared how difficult is it to get anniulment coz this marriage was not fraud and nor did i get my greencard he claims that even the INS officer suspected our marriage that we have 2nd interview .
please advice me

For you to get help you really need to explain things better. You married him in September and then November and yet he started proceedings for a divorce in August? That is not even logically.

i got married civil marriage in sept 2005 and religiously in nov 2005 and annulment is filed in sept 2006.

i entred us on visitor visa
