What is the name of your state (only U.S. law)? Florida

I wanted to find out from someone that has the knowledge, how it is determined who gets the engagement ring in an annulment? I have heard that if the engagement is broken, the ring should be returned but in the case of a divorce, the wife would keep it. If a marriage is voided as it is in an annulment does that mean the husband can have the ring back or would this be determined by a judge?

A divorce is easier to get than an annulment. If you have consummated the marriage then you can pretty much toss annulment out the window. :cool:

The court can decide on the property split/child support/child custody/alimony as in a divorce situation.

In most cases of divorce, the ring is considered a gift, not marital property, and is not returned:

However, in some parts of Florida, the ring is returnable if the engagement is broken, and annulment may fall under that category:

I hope that ring is worth a lot of money, because this process will cost you plenty. To your original question: if the parties cannot agree, then the judge will decide.

Let her keep it. A ring is a very cheap way to learn what you should never have done in the first place.
