Question

Another CA Mortgage Responsibilty Question


What is the name of your state? CALIFORNIA

When we agreed to separate Aug 1 '06, I gave spouse choice of my leaving or his leaving. He chose to stay in house.
I now live in apt, and cannot afford to pay rent PLUS 1/2 mortgage. I just don't have it.
In divorce agreement I am proposing, I am WAIVING my entitlement to portion of his retirement, and any/all other monies to which I am entitled by virtue of our 16 year marriage and his making $30K more than I do.
In return, I "let" him live in the house till our child graduates h.s., and we sell or buys my half at that time.(I also said he could have all furnishings; 3 of the 4 cars; we share son's expenses/time equally so no child support, etc etc)
Does this seem feasible?
I understand that the mortgage co doesn't care from where they get their $, as long as they get it. I also understand that we BOTH would suffer if he decided to default on mortgage payments. So I am taking the leap of faith that a) he doesn't want to ruin his own credit, and b) he doesn't want to lose the house.
Thanks for any advice, opinions.
