Anulment Grounds Russian NationalWhat is the name of your state?I am currently married to a Russian national, who is in the process of obtaining a green card through I-130 filing status. I reside in California and the marriage ceremony took place and was registered in the United States Virgin Islands in September of 2003. I wish to have my marriage annulled based on fraud, extreme mental duress since the marriage, and outrageous conduct by my wife since the marriage. Facts I presume to be pertinent in addition to the above: a) I met my wife in 2001 while she was a visiting Fulbright scholar in linguistics in California. b) We dated only 5 times prior to the marriage in 2005. c) She was never available for dating on weekend evenings. d) She said, and wrote via email that she left California due to immigration restraints in September of 2001. Subsequent immigration paperwork after marriage brought me the information that she did not depart California and the United States until December of 2001. e) Full email correspondence and phone conversations with her commenced in March of 2003. At that time, and up until we were married she was always able to be reached at her home mornings and evenings. f) Things were perfect with us until the last day of our honeymoon when she announced, “the honeymoon is over, I will need my own room to stay in while at home in San Diego”. This is also substantiated via emails. g) After marriage and up till now she has been close to impossible to reach via phone. In fact the last three months she has outright refused to talk with me on the phone yet, of course still wishes to continue with immigration proceedings. h) She constantly lies in emails trying to put me in a bad light. And while most cannot be refuted except by hearsay. Some can be factually disproved. i) She was in San Diego from Dec.17 to Dec. 29 cohabitating with me at my home. At this time I was forced to sleep on the couch, not in my own bed. j) On a visit to one of her friends homes, the driver of the vehicle which picked us up, seemingly let slip that he, my wife and her daughter used to laugh about being cooped up in his car driving all over San Diego when she was previously here in 2001. My wife gave him the evil eye and that ended that conversation. Although she felt compelled to say afterward they were only friends. k) After my wife arrived back in Russia she refused phone contact with me for 3 weeks in Jan. of 2002. l) Continual lack of ability to reach her via phone with more limiting email correspondence as time goes on. m) Was in Russia in June of 2004 and met her at a commuter train station in Moscow. When I went to kiss her she turned her head. I was in Moscow studying at Moscow State for three weeks on vacation. n) My wife has refused vacations with me to the Italian Riveria, Prague, Czechoslavokia and a long-standing request to visit with her in her hometown city of Kursk, Russia. She adamantly refuses any attempts for me to see her in her hometown. o) August of 2004 no contact whatsoever after email stating she was at the airport computer kiosk and would be going to a health resort for the entire month. p) September through October of 2004. Living at a different residence and refusing to give me the address. I wanted to send flowers for our wedding anniversary. In retrospect I never would have married her if I knew she lied to me regarding when she left the United States in 2001. Separate sleeping quarters is not something I ever would have agreed to prior to marriage. Months with refused phone conversations has caused me great duress. Almost all her actions post marriage I consider to be of outrageous conduct and not consistent with what was said and written to me before the marriage. It seems apparent to me that I have been duped into a sham marriage for reasons of immigration fraud, although the provability of this may be reaching.In your opinion do I have sufficient grounds for annulment of this marriage? And what are my best options for grounds on such a filing? I understand this could potentially be a very complicated case due to her being restricted from attending any hearings due to visa limitations as a foreign national. | You have grounds for a divorce in California, I suggest you contact a family law attorney if you wish to end your marriage, they can inform you of your options. |
