A back dated separation?

My ex husband to be just threatened me that we would be legally separated as of December 2nd (today is December 10) He has told me he had not filed, I have not been served either, can there be a predate on separation files? Or is he just trying to scare me?

Well, my ex and I never filed separation papers. We lived apart but filed taxes jointly until he wanted divorce. At trial, California judge ruled we were separated from the day he left the family home.
