Bifurcation no seperate trial


What is the name of your state?California. My ex husband and I were divorced in 2001. He was incarcerated and I was granted a bifurcation. The judge at the time said that either one of us could ask for a seperate trial later. However, we had no assets so I did not ask for one and neither did he. One major problem though. I had given birth in Dec. 2000 to a son. My sons father and I then married in September 2001. My son was not listed on the divorce or bifurcation papers. I listed my sons father on the birth certificate also. Now I am told that since my ex and I were legally married at the time, my ex husband is actually my sons legal father! My ex is still in prison and just found out about my son. I thought this would be easy but I did visit my ex in prison right around the time my son was conceived. (I do know for sure that he is not my sons biological father). What do I do now? From what I have read, my ex husband could ask for visitation of my son (and is threatening to do so) and since I did not mention my son in our divorce papers there is a good chance I would have to bring my son to the prison to visit him?! As far as I know my ex has not filed any papers, he also does not know where we live. I would like to figure out what to do now and how to make sure he is not my sons legal father! Help please!
