bills & property during separationWhat is the name of your state? New York My friend's husband has recently moved out due to marital problems. She is planning on filing for a legal separation. While he is out of the home, is he still legally responsible to still help pay the bills? The home is in both their names, but she is only living there with their baby. |

| Your friend's husband is responsible to abide by the terms of the creditors on each account that bears his name including the mortgage. Unfortunately he cannot be held liable for accounts solely in your friend's name. She should file for divorce as soon as possible so that she may have the property divided up through equitable distribution. |

| Ok, thank you for the response. I will let her know as soon as possible. One more question regarding their property, if her and her husband are in agreement that she keeps the home because of their child, is the judge likely to agree also? |
