Can he stop the divorce?!


What is the name of your state? Texas

My husband and I have been seperated for 6yrs. and I finally filed for divorce June 25, 2005 and my future ex has not signed any papers from my attorney. He now says he does not want the divorce. I received papers from the court saying my case will be dismissed June 25, 2006. Can his avoiding tactics deny me my divorce?What is the name of your state?

the court has already told you the case will be dismissed.

So I guess the answer is Yes. now, what reason did the court give you for dismissal?

All the letter stated was that there has been no set deposition in my case.

Your attorney needs to push the case forward as a contested divorce. You don't have to have your husband's signature to get divorced, you just have to proceed with the case on a contested basis.

Thanks, I've been trying to get in touch with my attorney (legal aid) I haven't heard from them since I filed the papers. Isn't that a bit odd?

Yes, that is more than a bit odd. I suspect that you really need a private attorney rather than legal aid if you want to stop spinning your wheels.

legal Aid normally cannot do a contested divorce unless there are special circumstances such as serious abuse issues. You will probably need a regular attorney.
