can i legally divorce this woman in this situation?


What is the name of your state?north carolina
ive been married for 25 years. me and my wife separated because of infidelity and deceit on her part. two months after we separated my wife was in a car accident and is now brain damaged and has the maturity of about a 13 y/o. she has been living with her mother since the separation and after the car accident. because of her medical situation, can i legally divorce her now? please help.

You will need to hire a lawyer to set up a guardianship/conservatorship for your wife. Your wife will also need a lawyer.

Then you will need to hire a lawyer to do your divorce.

NC has no fault and fault grounds for divorce, it seems that your question may be more about property settlements and alimony which is normally withheld with adultery, however, a judge may also allow for her mental disability. Getting an attorney is a very good idea as well as a guardian for her, unless you are willing to step up to your responsibility as her husband.
