Question

Can we divorce before selling our home?


What is the name of your state? Minnesota

My husband and I have been separated since the beginning of
May. He has recently decided the separation is not working
and he wants the divorce. We are still friends and get along.
The only financial obligation we share is the house. We both
want to sell it. Can we get the divorce before we sell the house
or would it be wiser to wait until the house is sold?

We plan on dividing up our property and trying to handle most
of the divorce paperwork ourselves. We want the divorce
to be as inexpensive as possible.

You need to ask a family law attorney in your state. My state allows for property division to be a separate issue from the actual divorce, in other words, here you can be no longer husband and wife before all other issues in the divorce are settled. In other states, you can't.

Can we divorce before selling our house


As long as you are filing a joint petition for divorce, you make sure to stipulate that the property is to be sold and the proceeds divided between you equally. No judge is going to make this more complicated than it already is.
