My husband and I need to get a divorce due to financial issues. Can we still live together while we are divorcing?

"Financial issues" is not listed as grounds for divorce in IL.

You CAN live together, but why would you want to? I would think it would make it very uncomfortable.
If a couple can barely afford the mortgage payment/lease payment they have while using BOTH their incomes/while together, it's understandable they cannot afford two separate household's until the home is sold/lease runs out

Divorce in Illinois

We have been married for 5 years. My husband has only occasionally worked.
He smokes pot and plays on the computer all day. He looks at gay porn and we are not having sex and never have had very often. I am currently unemployed and want to file for divorce myself. I own a house that I had before we were married and I just refinanced it and he signed a quick claims deed. I am not sure what to use for grounds. I heard that you have to live separate for 6 months. Is this true? Can this be waived? I cannot afford to support another person who just lays around. We never do anything together and have nothing in common. I have cobra insurance on me and he has none. I am worried about him getting sick and me being responsible. I have tried to make this marriage work, but he has no interest in it. I just can't take it anymore. I have fibromyalgia and diabetes and I look for a job everyday while he just lays around. Can I do this myself?

The basics

First of all - will your husband contest the divorce? If not, then doesn't Illinois have Dissolution of Marriage where both parties agree? If you can go that route it would be the cheapest.

If your husband does not want the divorce, where would he get the financial resources to hire an attorney to contest it?

I suggest you sell the computer and put a retainer down with a divorce lawyer if hubby won't agree to a dissolution.

Thanks! I told him I wanted a divorce this morning and he got mad and took off. I don't know where he is right now and it's a little creepy!

Protect yourself

You didn't mention if you had kids or anything, but hopefully you have family nearby for support. Make sure your protect your finances as best you can by closing credit card accounts, making sure he doesn't open credit in your name and if his name is on your checking/savings account, have him sign a form at the bank to remove his name.

His name is on none of my accounts. He has never been responsible. How can I keep him out now that he has left? It is very creepy not knowing when he might walk in the door.

You get a court order giving you sole possession of the marital home. Just because he is not on the accounts does not mean he is not entitled to half of them. All it means is that he does not have direct access to them.
