Car Given to Daughter But with Balance Due

When we tranferred the title to this car to our daughter, we also included our son-in-laws name. We gifted on the state title transfer.

However, they agreed, not in writing, to pay us $125 a month with no interest due to us. We have cancelled receipts and they owe us around $4,000. The original balance was $6,000.

My daughter is now asking for a divorce. They have no children and really no assets. He now wants the car without paying us any money for it, as a result of the divorce.

We do have the payment records along with some check numbers. What rights, if any, do we have to collect the balance due and not to just let him walk off with the car without paying us anything?

Well, your daughter can try to get the car awarded to her based on the fact that it was a gift from you........however I can't predict the outcome. However let this be a lesson to other posters who may see this....if you give a child a gift keep it in just your CHILD'S name.
