What is the name of your state?NC
I have recently caught my husband of 3 years having an affair. I am trying to find out exactly what kind of evidence that I will need to take into court.

Divorce

NC - I am going to file for divorce. I know that he will not openly admit to cheating so I want to make sure that I have what I need to prove it in a court of law.

Well, from what I'm seeing, adultery isn't grounds for divorce in NC. http://www.divorcenet.com/states/north_carolina/north_carolina_grounds_for_divorce says:

What are the grounds for divorce in North Carolina?

A divorce may be granted in North Carolina using either "Fault" or "No-Fault" grounds.

No-fault:
Living separate and apart without cohabitation for one year.

Fault:
1. Confinement for incurable insanity for three years;
2. incurable mental illness based on examination for three years.

Of these, the "No-Fault" ground is the most straightforward and easiest to prove.

It won't help you out because my soon to be ex wife was doing adultery and I cannot ever use that for court.
