Claiming Child on Taxes


What is the name of your state? Virginia

If I get joint custody with my kids, and my current wife, agrees to let me claim one of my kids on my taxes, is that legal? Can we do that?

Yes and get her agreement to this in writing.

Specify which child - take the youngest if you can ... you may want verbage about being current in support.

My guess was so I could claim a child on my taxes longer...

The opposite of that would be you won't be able to claim a child unless you are current, so are you going to include that verbage???

Once I get the house sold, I don't believe I will have any problems, paying child support...(knock on wood!) HA!

You already have the correct answer, but I am going to add something here. She needs to give you a signed form 8332. That is the waiver needed in case the IRS should mini-audit you.
