if my husband and i have a "common law" marriage, but have NOT filed any paperwork with the courthouse, do we need to file any paperwork for a divorce? if so, what documents do we need to file? thanks

A common law marriage is considered the same as a regular marriage. therefor you have to file for a regular divorce. There's no such thing as a "common law" divorce.
