What is the name of your state? TX

My husband and I divorce in April of 2004. We got back together in 2005. We never remarried but claimed to be married and did everything as married. We are seperating again. I realize that I still have to go through the divorce process. Are there different forms to file as common law married? Also, does the 60 days start from when I file or when he is actually served?
