community property question


What is the name of your state? la

My ex husband and I got married in LA, but he was in the military and we moved to WA. My child and I were in LA for a visit when he informed me that he wanted a divorce and our seperation and divorce went through LA. In our seperation agreement there was a restraining order against getting rid of our belongings since LA is a community property state. We were legally seperated in Feb 2003 and he left for Iraq in March, in that time he sold everything we owned together. I got nothing. He was due home in April when we agreed to go back to court to work the community property issue out, but a week ago he informed me that the military court martialed him and he is now serving a jail sentence in Germany(at present time) for 10 months. We haven't been together since Aug 2002 what are my rights as to getting my half of our community property and as far as the restraining order goes what can I do since he sold everything? BTW as of Oct i moved to Arkansas do I still do everything in LA?

If you can prove he sold the stuff during the time of the restraining order, tell you attorney, I would think this would be in contempt of the court.

Yes you would have to go back to LA on this. But you could also see an attorney where you live now to see about getting everything transferred to the court where you live now.

I am not an attorney and this is just my humble opinion.
