Contempt of DecreeWhat is the name of your state? Texas My Final Decree was signed by the Judge this past June. Ex-husband has not followed through with the terms of the Decree, specifically returning personal property and taking care of debt liabilities. I have not needed at attorney so far and can't afford to retain one. Court clerk said I can file my own Motion of Contempt to have him appear in court but I can't find the proper form for Texas online. Can you suggest the proper website? I'm also considering a defamation of character suit due to emails he has sent out telling third party individuals about my personal childhood abuse issues without my consent. How do I go about this type of suit? |

| I don't know the answer to your Texas law questions, but I do know that you should be able to get an attorney for either free or very inexpensively due to your financial situation. And if you do get an attorney, make sure you include a request for your ex's computer data. You have a right to requisition his Electronically Stored Information (ESI) due to the changes in the Federal Rules of Civil Procedure in December 2006. You can demand that a computer forensic expert take an image of his computer, thus captureing an evidence grade copy of the emails in question as well as perhaps personal financial files/data proving his ability to pay his debts. |
