Yes, that's called adultery. It could give your spouse a "fault" for divorce.

Anything the court wishes.

For example, in some states, seeing the couple holding hands in public is considered evidence of adultery.

Best bet? Stop having relationships until your divorce is final.

Though OP can't stop the EX from having relationships until the divorce is final. Which may be the way this is going.

That may be the scenario. Frankly, it's stupid no matter which one is having a relationship. Get the divorce over with before getting involved with someone else - not only for legal reasons, but because you're in no condition to be worrying about building a relationship while going through a divorce.
