What is the name of your state (only U.S. law)? PA
My daughter, my husband and I own a property together, however, we will be filing for divorce soon. Does the courts have jurisdiction that will affect my daughter's interest in the house? Also, we do not have a contract between the three of us on what will occur to the house if a divorce occurs. How does the court rule on who should take possession if my husband and I do not come to an agreement? Thank you.

The court would have no jurisdiction over your daughter's share of the home. That means that it could get very complicated, ugly and expensive if the two of you cannot come to an agreement.

How much equity does the home have, and are there any other significant marital assets?
